My name is Daniel J. Herman ESQ.  I am an attorney at law licensed to practice in the courts of the State of Florida, and in the United States District Court and Bankruptcy Court for the Middle District of Florida, and the federal 11th Circuit Court of Appeals. I welcome your contact today.

Since bankruptcy law is federal law under Title 11 of the United States Code, board certification of bankruptcy practitioners is exercised and supervised on the national level by the American Board of Certification.  Board certification in bankruptcy law was first available in 1992 pursuant to examinations held in Washington, D.C.. Separate examinations were given for certification in “business” bankruptcy and “consumer” bankruptcy.

I was awarded certification by the American Board of Certification in 1992 in both “BANKRUPTCY-BUSINESS” and “BANKRUPTCY-CONSUMER”. These Board Certifications have been continuous since 1992, and are now current.
 
This year is my 29th consecutive year practicing law in the State of Florida. For 24 of those years, my practice has been essentially limited to the practice of bankruptcy law. I work with bankruptcy law every day. The continuing education requirements for board certified attorneys are far more stringent, requiring many more hours of continuing education, than requirements for general practitioners. I am conscientious in pursuing continuing education so that know and understand the changes in the law as they occur.

The 2005 changes in bankruptcy law, by the Bankruptcy Abuse, Prevention and Consumer Protection Act are fully integrated into my regular daily practice.

I personally handle each client’s legal matters. I am proud to say that I take the time to get to know my clients arid understand their circumstances. For any court appearances, I will be there, not an associate or other attorney new to you.

I handle personal cases and business cases in Bankruptcy Code Chapters 7, 11 and 13. I work with real people and with fictitious persons - such as corporations. Even in corporate cases there are real persons emotionally invested and subject to real consequences. It is a priority for me to provide an empathetic and non-judgmental refuge where my clients can learn about their rights and duties, and perform the work necessary to obtain bankruptcy relief.

A major source of my clients is referrals from other attorneys, both general practitioners and other bankruptcy practitioners, who recognize that I can grapple with complex and confusing fact situations and apply my knowledge, expertise and creativity coupled with empathy and compassion. I enjoy challenges and I eagerly accept many difficult cases. I have successfully helped thousands of people deal with severe financial trouble.

I personally meet with each client and spend the time it takes to gather and understand the facts of their case. I then advise my clients in plain understandable language of their options and consequences. When it is necessary to use legal terms, I explain them. Questions are welcomed. It is important to me that you understand your legal circumstances, my advice, and your options so that we can most effectively assert and protect your rights.

In my senior year at Stetson Law School, I took the course “BANKRUPTCY”, taught by then Chief Judge Alexander Paskay of the Bankruptcy Court for the Middle District of Florida, Tampa Division, (now Chief Judge Emeritus). I received the American Jurisprudence “Book Award” for the highest grade in that class. I have been passionately immersed in bankruptcy law ever since.

I have practiced law since 1980 in the same court, the Bankruptcy Court for the Middle District of Florida, Tampa Division. Since 1980 I have practiced law from the same building, at the same address. I have practiced with the other attorney in the firm, John H. Pecarek, for the same length of time.

I represent debtors in all chapters of bankruptcy, primarily Chapter 7, Chapter 13 and Chapter 11. I also represent creditors in all chapters. I am a bankruptcy mediator. I defend nondebtor transferees from collection efforts by transferors.
 
I have a God-given talent that assists all in being helpful and effective for my clients. I have an irrepressible and slightly irreverent sense of humor that lightens our meetings and interactions. Many have felt it helped the “medicine go down”.
