Chapter 7, 13 and 11 Creditor Representation
The firm of Pecarek & Herman Chtd was formed in 1984 when a predecessor firm dissolved. There are only two attorneys in the firm, myself, Daniel J. Herman ESQ, and John H. Pecarek. Mr. Pecarek does not practice in the area of bankruptcy law. Contact us today.
Daniel J. Herman Esq, John H. Pecarek Esq, and Pecarek & Herman Chtd have each been awarded and designated the Martindale-Hubbell “AV” rating*.
Attorney Herman practices bankruptcy law from a building located at 200 Clearwater-Largo Road South, Largo, Florida. This is a central and convenient location to all of Pinellas County. Because of my reputation and long years of practice, I am often referred clients from neighboring counties, such as Pasco, Hernando, Polk, Manatee and Sarasota Counties. The Federal Bankruptcy Court located in Tampa is the only bankruptcy court for these and other Florida West Coast counties.
While my practice focuses on consumer and business bankruptcy cases, I am also familiar with ASSIGNMENTS FOR BENEFIT OF CREDITORS, which is a unique remedy similar to a form of bankruptcy authorized under Florida state law administered through the Florida state courts. This is a remedy which complements the arsenal of chapters available in federal bankruptcy law. It is sometimes particularly effective in allowing the sale of the assets of a business, including going concern value now operating, but free and clear to the buyer of the claims of creditors. Creditors receive the proceeds of the sale administered under the supervision of a Florida state circuit judge.
