My job includes the following:

  • Represent clients in Chapter 7, Chapter 13 and Chapter 11 cases.
  • Properly assert claim with the court.
    Determine amount owed and legal rights.
  • Help creditor assess what further actions are appropriate.
    Attend creditors' meetings to enquire about assets or transfers that may lead to higher recovery than is proposed by the debtor.
  • Determine additional rights and protection to maximize rights and recovery when creditor is secured by a lien on real or personal property.
  • · Advise as to extent to which further representation is needed.
    Detailed discovery regarding assets, rights, and transfers may provide more recovery to creditors.

  • Perform litigation necessary to preserve claims, collateral, and rights.
  • Guide clients through understanding secured, unsecured and tax debt issues.

I represent clients to defend preference actions as well. Preference in bankruptcy involves a debtor attempting to recover payments made by the debtor to a creditor before the bankruptcy petition was filed. I defend preference recipients in preference-recovery actions.

In addition to bankruptcy law, I also handle assignment for the benefit of creditors, in which a business owner has a business with value to sell as a going concern. When there would not otherwise be an interested buyer due to the debt that the buyer would have to take on, assignment for benefit of creditors involves the court approving sale for a buyer to acquire the business while avoiding creditors' pursuit after the purchase.
