Business Debt Reorganization Bankruptcy

Chapter 11 bankruptcy is debt reorganization bankruptcy. In Chapter 11 a business can remain in business and try to fix its financial problems as opposed to a liquidation bankruptcy. Liquidation bankruptcy, i.e., Chapter 7, requires the closure of a business, sale and then subsequent distribution of sale proceeds to creditors. The upside of Chapter 11 bankruptcy is that you can continue normal business operations while simultaneously making organizational changes to improve the business's financial circumstances. This may include getting rid of unprofitable locations, downsizing employees and other various efficiency changes. Once a business is able to form a plan, this is submitted to the bankruptcy court and disseminated to creditors. Creditors will then be given an opportunity to vote on this plan.

Chapter 11 maybe appropriate for high debt individuals with multiple investments and business properties. Chapter 11 is generally utilized by individuals, (human beings - as opposed to corporations), only when their debts exceed the eligibility limits of Chapter 13.

Controlled Liquidation

There are some circumstances in which Chapter 11 bankruptcy can be used for an orderly liquidation. Essentially, rather than having a Chapter 7 trustee liquidate assets at a fire sale, a controlled liquidation through Chapter 11 would allows the Debtor Business to handle the liquidation as Debtor In Possession. As the business owner, you have the most knowledge in understanding how to maximize sale proceeds so that all parties involved, including creditors, would potentially get more money.
